GENERAL TERMS AND CONDITIONS OF CONTRACTING AND ONLINE SALES

2. Purpose

These conditions govern the distance contracting of the services, bookings, passes, activities, birthday parties, events and other offerings that FLIPOPARK makes available through flipopark.es or ClubFlipo. The essential characteristics, availability, date or period of performance, price and particular conditions of each service will be shown before contracting is completed.

3. Capacity to contract and minors

Contracting must be carried out by a person of legal age and with sufficient legal capacity. Where the service is intended for a minor, the contracting party declares that they are the minor's parent or legal guardian, or that they have sufficient authorisation to contract the service and to provide the strictly necessary data of the minor.

4. Contracting process

  1. Select the available service, activity, date, time slot, pack, pass or offering.
  2. Enter the requested data and check that it is correct.
  3. Where necessary, report allergies, allergens or diets and give separately the consents required for special categories of data.
  4. Review the order summary, total price and applicable conditions.
  5. Accept these Contracting Conditions and, where applicable, make the payment through the enabled gateway.
  6. Once the request or payment has been received, FLIPOPARK will send a confirmation to the email address or other means provided. The booking will be subject to availability where so indicated during the process.

Before confirming the contract, the user may correct the data entered by using the edit or back options of the form. The contract may be concluded in Spanish (castellano) and, where the interface allows, in the other languages available on the site.

5. Filing and confirmation of the contract

FLIPOPARK will retain the contracting information and the records necessary to prove the transaction for the legally required periods. The user will receive a confirmation of the contract by a means that can be stored and reproduced, normally email.

6. Prices and taxes

Prices shown before the purchase is completed will include the legally applicable taxes, unless expressly stated otherwise by reason of the nature of the service or of the recipient. Before payment is confirmed, the total amount payable will be shown, including, where applicable, any supplements or extras selected.

7. Payment method: Redsys

When online payment is enabled, it will be made through Redsys and the acquiring financial institution. The user will be redirected or connected to the secure environment of the gateway to enter the necessary data. FLIPOPARK does not store the full card number or the security code.

The contract will be considered paid when FLIPOPARK receives valid confirmation from the gateway. If the transaction is rejected, cancelled or cannot be completed, the booking or purchase may remain pending or unconfirmed, as indicated on the relevant screen.

8. Bookings, availability and changes

Dates, time slots, places and services are subject to availability. Merely completing a request does not guarantee the booking where the process indicates that later confirmation is required. FLIPOPARK will communicate any inability to provide the contracted service and, where appropriate, will propose an alternative or refund the amounts paid without undue delay.

Changes requested by the user are subject to availability and to the particular conditions of the contracted service. Where a change affects the price, the user will be informed and must accept it before it is confirmed.

9. Cancellations

The specific conditions on cancellation, change of date, non-attendance or refund applicable to each service must be shown before payment and will form part of the contract. In the absence of a more favourable particular condition, a refund will only be due in the cases legally required or where FLIPOPARK cannot provide the contracted service for a reason attributable to the establishment.

If FLIPOPARK commercially establishes free cancellation periods or penalties for late cancellation, they must be shown clearly before contracting and may never limit the mandatory rights of the consumer.

10. Right of withdrawal

As a general rule, contracts concluded at a distance may be subject to a statutory withdrawal period. However, under Article 103.l) of the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios (General Consumer and User Protection Act), the right of withdrawal does not apply to the provision of services related to leisure activities where the contract provides for a specific date or period of performance.

Accordingly, bookings for birthday parties, events, activities or leisure services contracted for a specific date or period do not carry the statutory fourteen-day right of withdrawal, without prejudice to the cancellation or change conditions that FLIPOPARK voluntarily offers and to the rights that apply in the event of breach by the trader.

Where any service without a specific date or period, to which the right of withdrawal does apply, is marketed, FLIPOPARK will provide the corresponding information and the statutory form before contracting.

11. Rules of use and safety

Contracting a service implies compliance with the rules on access, safety, capacity, supervision and use of the premises. Persons responsible for minors must truthfully report any allergy, health circumstance or need relevant to safety where that information is necessary for the service.

The existence of an allergy, special need or health circumstance does not in itself guarantee that FLIPOPARK can provide any requested service. Where necessary for objective safety reasons, the family will be informed of the measures possible or of the impossibility of providing a particular activity under the conditions required.

12. Passes, wallet and points programme

Where passes, wallet balance or loyalty programmes are offered, their specific conditions —validity, use, expiry, accrual, redemption, cancellation and treatment of the balance— will be shown before purchase or enrolment. Joining the points programme is voluntary and cancellation may be requested in accordance with the published conditions.

13. Communications

Communications relating to bookings, payments, changes, cancellations or safety are operational in nature and form part of the contracted service. Commercial or promotional communications will only be sent where there is a valid legal basis and a simple, free-of-charge opt-out mechanism will always be provided.

14. Data protection

Personal data provided during contracting will be processed in accordance with FLIPOPARK's Privacy Policy. Online payments will be processed through Redsys. Health data or diets that reveal special categories will require explicit consent where applicable.

15. Customer service and complaints

For enquiries, incidents or complaints you may write to flipoparkpontevedra@gmail.com or visit the establishment at C/ Echegaray, 26, Bajo, 36002 Pontevedra. FLIPOPARK has official complaint forms (hojas oficiales de reclamaciones) as required by the applicable regulations.

16. Force majeure

Neither party shall be liable for failures caused by unforeseeable or unavoidable events beyond its reasonable control, without prejudice to the rights to a refund or rescheduling that legally apply where the service cannot be provided.

17. Governing law and dispute resolution

Contracting is governed by Spanish law and, in particular, by the regulations on consumers and users and on electronic commerce. If the contracting party is a consumer, the courts and tribunals determined by the mandatory consumer protection regulations shall have jurisdiction, and these conditions do not impose a different forum to the detriment of the consumer.
